Federal supply and service contractors and subcontractors with a contract of $50,000 or more and 50 or more employees must certify compliance with Executive Order 11246 and Section 503 of the Rehabilitation Act of 1973 annually. Those with contracts of $150,000 or more must also certify compliance with the Vietnam Era Veterans' Readjustment Assistance Act of 1974. Covered employers that don't certify increase their risk of being reviewed by the Department of Labor's Office of Federal Contract Compliance Programs.

The Contractor Portal is OFCCP's encrypted platform where covered federal contractors and subcontractors must certify on an annual basis whether or not they are meeting their requirements to develop and maintain affirmative action plans (AAPs).
Employers with a supply and service contract of $50,000 or more and 50 employees or more must certify compliance with the regulations covering minorities and women (Executive Order 11246) and the regulations covering individuals with disabilities (Section 503 of the Rehabilitation Act of 1973). The Contractor Portal remains open indefinitely. However, the most recent filing period began on April 1, 2024. Contractors needed to certify by July 1, 2024 or be considered delinquent.
OFCCP uses certification information to help determine contractors’ compliance with their requirements to develop and maintain AAPs. At this time, OFCCP requires annual certification to monitor AAP compliance on a regular basis. OFCCP has indicated that failure to certify appropriately may result in an increased chance of being selected for a compliance review. In addition, improper certification can come with severe penalties, including perjury.
